You will see it advertised in salons, at beauty counters and occasionally in shopping centres: whitening treatments at a fraction of dental prices. Beauty salon teeth whitening is, however, illegal in the UK, and it has been for many years. That surprises people, so it is worth explaining what the law says and, more importantly, why it exists.

What the law actually says
Tooth whitening is legally classed as the practice of dentistry in the UK. That means it may only be carried out by a dental professional registered with the General Dental Council: a dentist, or a hygienist or therapist working to a dentist’s prescription.
Anyone else offering it is practising dentistry illegally, which is a criminal offence. The GDC has brought numerous prosecutions of beauty salons and individuals over the years, and continues to do so.
There is a further restriction: whitening for cosmetic purposes may only be carried out on people aged 18 or over.
Why the law exists
Not to protect dentists’ income, which is the usual assumption. It exists because whitening safely requires knowing things that only a dental examination reveals.
Before whitening, several things need checking:
- Is there untreated decay? Whitening gel reaching an exposed nerve through a cavity is genuinely painful and can cause real damage.
- Are the gums healthy? Whitening inflamed gums is uncomfortable and inadvisable.
- Are there cracks or exposed roots? Both allow gel to reach places it should not.
- What is causing the discolouration? Some staining does not respond to whitening at all, and some indicates an underlying problem such as a dying nerve.
- Are there crowns or veneers in the smile line? They will not lighten, so the plan needs to account for them.
A beauty therapist cannot answer any of those questions, because answering them is dentistry.
What actually goes wrong
The documented harm from unregulated whitening includes chemical burns to the gums, lips and inner cheeks, prolonged and severe sensitivity, damage to the soft tissues from ill-fitting trays, and treatment carried out over untreated decay or gum disease.
Ill-fitting trays are a recurring theme. A one-size tray lets gel escape onto the gums, where it sits for the duration of the treatment. Custom trays made from impressions of your own teeth are designed specifically to prevent that.
The workarounds you may be offered
A few arrangements have been used to sidestep the law, and it is worth recognising them.
“You apply it yourself.” The salon hands you the gel and tray and says you are self-administering, so no treatment is being provided. This has not generally succeeded as a legal defence where the salon is supplying, instructing and supervising.
“It is not whitening, it is stain removal.” Sometimes true, in which case the product is too weak to do much. Sometimes simply a relabelling of the same treatment.
“A dentist supervises remotely.” Genuine remote prescribing without an examination does not address the reason the law exists.
The practical test is simple: if nobody with a dental qualification has examined your mouth, the safeguards are absent whatever the arrangement is called.
The strength question
Dentists in the UK may use whitening products containing up to 6% hydrogen peroxide, or equivalent. Products sold directly to consumers are legally capped at 0.1%, which is roughly sixty times weaker and too weak to meaningfully lighten teeth.
This creates an awkward position for anyone operating outside the law. Either they use legal, consumer-strength product, which barely works, or they use professional-strength product they are not entitled to hold, which is where the burns come from.

What happens if it goes wrong
This is the part people consider least and regret most.
A registered dental professional is accountable to the GDC, carries indemnity insurance, and must follow professional standards on consent and record-keeping. If something goes wrong, there is a complaints process and a route to redress.
An unregistered salon has none of that. If you are harmed, your options are limited and often practically worthless, particularly if the business closes.
How to tell a legitimate provider
- The provider is registered with the GDC, and you can check any name on the public register online.
- You have a dental examination first, including your teeth and gums, before any gel appears.
- Trays are custom-made from impressions or a scan of your own teeth.
- You are told what strength gel you are being given and how to use it.
- Your existing dental work is discussed, because it will not lighten.
- You are asked about sensitivity and the plan is adapted accordingly.

One honest alternative worth knowing: if what bothers you is surface staining from tea, coffee or smoking, a professional scale and polish removes it and often gets people closer to their goal than they expected, at lower cost than whitening.
